Biden had not been sworn in as POTUS 1/6/21 and had no authority to do anything about them until 1/20/21 at 12pm. Trump & his administration were still in power. In a perfect scenario, what should have happened was that VP Pence should have attempted to have Trump removed under section 4 of the 25th amendment for leading an insurgency against the US Capitol. Likely he would not have been successful in meeting the criteria to proceed, but should he have done so, then he would have been elevated to POTUS for the remaining weeks of the term, & he should have issued some emergency order (it would be a legitimate one because there was an insurgency that had taken over the Capitol) that allowed for immediate arrest for anyone involved in the insurrection including Trump. Then come 1/20/21 Biden should have then keep the emergency order in place and continue rounding up all these people.
